MUNICIPAL ORDINANCE NO. 2006-002

AN ORDINANCE ADOPTING AND/OR GIVING CONTINUED SUPPORT TO THE NATIONAL HEALTH INSURANCE PROGRAM AND ITS GOVERNING RULES SET FORTH IN R.A. 7875, AS AMENDED BY R.A. 9241, AND ITS REVISED IMPLEMENTING RULES AND REGULATIONS

BE IT ORDAINED by the Sangguniang Bayan of the Municipality of Cabatuan, Iloilo, in Session Assembled.

Section I. TITLE - “An ordinance adopting of and/or continued support to the National Health Insurance Program and its governing rules as set forth in RA 7875 as amended”

Section II. AUTHORITY AND PURPOSE – As provided forth in Article II, Section 15 of the Philippine Constitution, it states that the “State shall protect and promote the right to Health of the people and to instill health consciousness among them.” and Article XIII, Section II further states that the State shall adopt an integrated and comprehensive approach to health development which shall endeavor to make essential goods, health and other social services available to all the people at affordable cost. There shall be priority for the needs of the underprivileged, sick, elderly, disabled, women and children.

Section III. SCOPE OF APPLICATION – This ordinance shall be adopted by the Municipality in the implementation of the National Health Insurance Program.

Section IV. UNDERTAKINGS OF THE MUNICIPALITY

4.1 Adoption of and/or continued support to the National Health Insurance Program and its governing rules as set forth in R.A. 7875 as amended by RA 9241, and its Revised Implementing Rules and Regulations. Such support shall include active advocacy for NHIP participation by private and non-government organizations within its territorial jurisdictions, mandating compliance to the NHIP rules by entities required to obtain LGU permits/licenses, and setting up of revolving funds for medicines in owned or managed hospitals, as may be warranted under existing rules/guidelines or similar future arrangements and/or NHIP issuance;
4.2 Grant of authority to the Mayor to enter into an agreement with the PhilHealth and/or interpose favorable modification, revisions and/or amendment thereto
4.3 Continuous allocation of funds as the LGU’s counterpart subsidy for qualified beneficiaries within its jurisdiction as evidenced by a Certificate of Availability of Funds.

4.4 Set-up a PhilHealth Capitation Fund from the proceeds out of the capitation amount of Three Hundred (P300.00) pesos per family with paid premium whose use, management and disposition shall be governed by the rules stipulated in the Outpatient Consultation & Diagnostic Package Guideline and pertinent Memorandum of Agreement.

Section V. ENFORCEMENT AGENCY – The Municipal Health Office, Sangguniang Bayan and Municipal Treasurer’s Office are hereby mandated to strictly enforce this ordinance.

Section VI. REPEALING CLAUSE – Any Ordinance found inconsistent with this Ordinance is hereby modified or repealed.

Section VII. SEPARABILITY CLAUSE – Any part of this Ordinance that is declared null and void shall not have any effect on the entirety of the Ordinance.

Section VIII. EFFECTIVITY CLAUSE – This Ordinance shall take effect after furnishing copy of this ordinance to the President of the Philippines, Her Excellency GLORIA MACAPAGAL ARROYO and President/Chief Executive Officer of the Philippine Health Insurance Corporation, Honorable FRANCISCO T. DUQUE III and the Provincial Governor of the Province of Iloilo, Honorable NIEL D. TUPAS, SR., for their information.
